Nazarbayev signed law on advocacy and legal assistance
The law introduces obligatory insurance of the occupational responsibility of attorneys and legal consultants.
The Kazakh head of state signed the law on advocacy and legal assistance aimed at improving the legislation in the sphere of legal assistance provision to citizens, a press service of the Akorda reports.
Also, the Kazak President signed the related amendments to the legislation. Texts of the laws are being published in the press.
The law introduces obligatory insurance of the occupational responsibility of attorneys and legal consultants, that will ensure guaranties to trustees in providing and receiving qualitative legal assistance. An insurance institute will be introduced in 2020.
In order to familiarize the population and fair pricing, the development of a recommended wage scale for paying the assistance of the attorney or legal consultant following the experience of the states of Europe is envisaged.
“For socially vulnerable groups of the population, the draft law provides for receiving legal assistance from attorneys and legal consultants with full free-of-charge support in their legal situation. It will be called as pro bono. The provision of such an assistance will be based on voluntary agreement and will be gratuitous. It is also important that the provision of a pro-bono assistance is not an obligation, but a right, and cannot be provided under force,” said Minister of Justice Marat Beketayev during presenting the draft law in the Majilis.
