Russian government approves draft Agreement to set up a Bureau of air accidents investigation within EEU
The Agreement's implementation will ensure the creation of an Interstate agency authorised by the EEU member states to conduct investigations of air occurrences and to train relevant professionals.
The draft Agreement to create an International Bureau for Investigations of aviation occurrences and serious incidents within the EEU was approved by the government of the Russian Federation, a website of the Russian government informs.
In accordance with the Convention on International Civil Aviation, each State party of the International Civil Aviation Organization (ICAO) shall establish a relevant authority investigating aviation occurrences, independent of other government authorities, or to transfer investigative powers to other government or inter-state agencies
It is known that in Russia the functions of such an authority are assigned to the Interstate Aviation Committee (hereinafter - IAC). IAC was established in accordance with the Agreement on civil aviation and on use of airspace concluded in December 1991 in Minsk (hereinafter - the 1991 Agreement) by the governments of the states making up the Commonwealth of Independent States.
"The draft Agreement defines the main functions of the Bureau: to investigate aviation occurrences and serious incidents in accordance with the requirements of the ICAO documents; to ensure an independent and impartial investigation of aviation occurrences and serious incidents; to cooperate and interact of the Parties regarding investigations of aviation occurrences and serious incidents, international cooperation of the Parties with other interested states; to develop and use of the global framework of inquiry rules and procedures into air occurrences and serious incidents; to facilitate the use of the common guidance materials, manuals and handbooks for investigative experts," reads the report.
The draft Agreement provides for the bringing national laws into line with the rules, designed by the Bureau based on the ICAO documents, in the field of investigation of air occurrences and serious incidents by the Parties.
Upon the agreement with other interested states, the Bureau will be able to independently investigate or be involved in such investigations alongside with national investigative agencies.
